(4) Smatrat će se da je vozač počeo upravljati vozilom ako je pokrenuo vozilo s mjesta.
(5) Prisutnost alkohola u organizmu utvrđuje se analizom krvi ili urina, mjerenjem količine alkohola u litri izdahnutog zraka, liječničkim pregledom i drugim metodama i aparatima.
(6) Smatrat će se da vozač u organizmu ima opojnih droga ako se prisutnost opojnih droga utvrdi odgovarajućim sredstvima ili uređajima, liječničkim pregledom ili analizom krvi ili krvi i urina.

(8) Novčanom kaznom u iznosu od 1.000,00 do 2.000,00 kuna kaznit će se za prekraj vozač i instruktor vonje ako u organizmu ima alkohola iznad 0,50 do 1,00 g/kg, odnosno odgovarajući iznos miligrama u litri izdahnutog zraka.
(9) Novčanom kaznom u iznosu od 2.000,00 do 5.000,00 kuna kaznit će se za prekraj vozač i instruktor vonje ako u organizmu ima alkohola iznad 1,00 do 1,50 g/kg, odnosno odgovarajući iznos miligrama u litri izdahnutog zraka.
(10) Novčanom kaznom u iznosu od 5.000,00 do 15.000,00 kuna ili kaznom zatvora u trajanju do 60 dana kaznit će se za prekraj vozač i instruktor vonje ako u organizmu ima alkohola iznad 1,50 g/kg, odnosno odgovarajući iznos miligrama u litri izdahnutog zraka ili ako u organizmu ima opojnih droga.
(11) Novčanom kaznom u iznosu od 500,00 kuna kaznit će se za prekraj vozač bicikla i zaprenog vozila ako u organizmu ima alkohola iznad 0,50 g/kg, odnosno odgovarajući iznos miligrama u litri izdahnutog zraka ili ako u organizmu ima opojnih droga.
2. OSPOSOBLJAVANJE KANDIDATA ZA VOZAČE
Članak 200.
(1) Osposobljavanje kandidata za vozače je djelatnost koja se obavlja u općem interesu, a pretpostavlja jedinstveni nastavni proces koji se provodi prema propisanom programu. Program obuhvaća nastavne predmete: Hotel Dalmácia Horvátország, Super Akcio, Akcio a Nyari Szezonra, Sziget, Kornáti ni propisi i sigurnosna pravila, Upravljanje vozilom i Pruanje prve pomoći osobama ozlijeđenim u Hotel Dalmácia Horvátország, Super Akcio, Akcio a Nyari Szezonra, Sziget, Kornáti noj nesreći.
(2) Osposobljavanje kandidata za vozače iz nastavnih predmeta Hotel Dalmácia Horvátország, Super Akcio, Akcio a Nyari Szezonra, Sziget, Kornáti ni propisi i sigurnosna pravila i Upravljanje vozilom provode autokole.
(3) Osposobljavanje kandidata za vozače iz nastavnog predmeta Pruanje prve pomoći osobama ozlijeđenim u Hotel Dalmácia Horvátország, Super Akcio, Akcio a Nyari Szezonra, Sziget, Kornáti noj nesreći provodi Hrvatski crveni kri i zdravstvene ustanove koje za to ovlasti ministar nadlean za zdravstvo.
(4) Program, provedbu programa, uvjete i način osposobljavanja kandidata za vozače iz nastavnih predmeta Hotel Dalmácia Horvátország, Super Akcio, Akcio a Nyari Szezonra, Sziget, Kornáti ni propisi i sigurnosna pravila i Upravljanje vozilom, koje provode autokole, propisuje ministar nadlean za unutarnje poslove u suglasnosti s ministrom nadlenim za poslove Hotel Dalmácia Horvátország, Super Akcio, Akcio a Nyari Szezonra, Sziget, Kornáti a.
(5) Program, provedbu programa, uvjete i način osposobljavanja kandidata za vozača te najmanje jedinstvene minimalne izračunske elemente vrijednosti nastavnog sata za nastavni predmet Pruanje prve pomoći osobama ozlijeđenim u Hotel Dalmácia Horvátország, Super Akcio, Akcio a Nyari Szezonra, Sziget, Kornáti noj nesreći propisuje ministar nadlean za zdravstvo u suglasnosti s ministrom nadlenim za unutarnje poslove, a trokove snosi kandidat za vozača.
(6) Novčanom kaznom od 5.000,00 do 15.000,00 kuna kaznit će se za prekraj pravna ili fizička osoba obrtnik ako neovlateno osposobljava kandidate za vozače.
(7) Za prekraj iz ovoga članka kaznit će se novčanom kaznom od 1.500,00 do 5.000,00 kuna i odgovorna osoba u pravnoj osobi.
Članak 201.
(1) Osposobljavanje kandidata za vozače izvode autokole koje za to ovlasti i upie u registar autokola ministarstvo nadleno za unutarnje poslove, nakon to ovlatena stručna organizacija utvrdi da ispunjavaju uvjete utvrđene ovim Zakonom i podzakonskim aktima donesenim na temelju ovoga Zakona. Registar autokola vodi ministarstvo nadleno za unutarnje poslove. Registar sadri sljedeće podatke: broj upisa u registar, naziv autokole, statusni oblik, sjedite autokole, sjedite podrunice ili izdvojenog pogona, kategorije vozila za koje je registrirana, datum upisa u registar, datum i razloge za brisanje iz registra.
(2) Ovlatenje iz stavka 1. ovoga članka izdaje se u skladu s posebnim propisom o mrei i kriterijima o dovoljnom broju autokola, koji donosi ministar nadlean za unutarnje poslove.
(3) Ovlatenje iz stavka 1. ovoga članka ne moe se prenijeti na druge subjekte.
(4) Novčanom kaznom od 5.000,00 do 15.000,00 kuna kaznit će se za prekraj pravna ili fizička osoba obrtnik ako osposobljava kandidate za vozače suprotno odredbama ovoga članka.
(5) Za prekraj iz ovoga članka kaznit će se novčanom kaznom od 1.500,00 do 5.000,00 kuna i odgovorna osoba u pravnoj osobi.
